Terms of service

These Terms govern your use of The Cloud Caller (“Service”), operated by Ammacatize Pty Ltd as trustee for the A P E Z Family Trust (ABN 45 142 725 170) (“we”, “us”, “our”). By using the Service — whether as a tradie subscribing to it, or as a member of the public calling a serviced number — you agree to these Terms.
1. The Service
The Cloud Caller is an AI-powered call-handling and booking service for Australian trade businesses. Key functions:
- Answers inbound calls on behalf of a subscribed tradie
- Collects job details and books appointments in the tradie’s calendar
- Sends booking confirmations by SMS and calendar invite
- Provides the tradie with a daily/weekly call summary
2. If you are a tradie customer
2.1 Subscription
Access is by monthly prepaid subscription. Pricing is set out in your subscription agreement. We may update pricing on 30 days’ notice.
2.2 Your responsibilities
You must:
- Provide accurate business and contact details at onboarding
- Keep your calendar availability accurate
- Respond to bookings within a reasonable time
- Not use the Service for illegal, misleading, or harmful activity
- Tell end-customers you use an AI-assisted call-handling service where required by law
2.3 What we don’t do
The Service is call-handling and booking. It is not:
- A replacement for emergency services (000) — callers in a life-safety situation are advised to call 000
- A dispatch or quoting service — the tradie quotes and attends the job
- A debt collection or payment processing service
2.4 Suspension and termination
We may suspend or terminate your subscription if you breach these Terms, if your account is unpaid, or if continuing service would expose us to legal risk. You can cancel at any time; we do not refund unused portions of a prepaid month.
3. If you are a caller
Calls to numbers serviced by The Cloud Caller are answered by an AI agent, recorded, and processed as described in our Privacy Policy. You consent to recording and AI processing by continuing the call after the AI identifies itself. If you do not consent, hang up and contact the tradie through an alternative means.
You must not use the Service to harass, threaten, or defraud anyone. We may terminate calls and retain records where we reasonably suspect misuse.
4. SMS
If you provide your number for a booking, you consent to receive transactional SMS messages related to that booking. These are not marketing messages. Reply STOP to any message to opt out of further non-essential SMS. Standard carrier rates may apply.
5. Intellectual property
The Service, including software, prompts, voice model configurations, and documentation, is our intellectual property. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your subscription. You may not reverse-engineer, resell, or build a competing service on top of our Service.
6. Third-party services
The Service integrates with ElevenLabs, Twilio, Cal.com, and other providers listed in the Privacy Policy. Those providers’ own terms may also apply to how your data flows through them. We are not responsible for their acts or omissions beyond our own due diligence in selecting them.
7. Warranties and liability
7.1 Service is “as is”
We warrant that we will deliver the Service with reasonable care and skill. Beyond that, the Service is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or suitable for any particular purpose beyond what is described on our website.
7.2 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can lawfully be limited, our aggregate liability to you for any claim is limited, at our option, to:
- Resupply of the Service, or
- The amount paid by you to us in the 3 months preceding the claim.
7.3 Exclusions
We are not liable for indirect or consequential loss, loss of profits, loss of goodwill, or loss of opportunity, even if advised of the possibility.
8. Jurisdiction
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
9. Changes
We may amend these Terms on 30 days’ notice (for tradie subscribers) or by publishing an updated version on this page (for callers). Your continued use after an amendment takes effect is acceptance of the new Terms.
